Welcome to Vinstigator. The terms "we," "us," and "our" refer to Vinstigator.

Vinstigator operates this store and website, including its related information, content, features, tools, products, and services (collectively, the "Services"). Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and services to you.

These Terms of Service, together with the policies referenced herein, describe your rights and responsibilities when using the Services.

By visiting, interacting with, purchasing from, or otherwise using our Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not use the Services.

Section 1 — Access & Account

By using the Services, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you have provided any legally required consent for a minor dependent to use the Services.

You may be required to provide information such as your email address, billing information, payment information, and shipping address.

You agree that information you provide is accurate, current, and complete and that you have the right to provide it.

If you create an account, you are responsible for maintaining the security of your account credentials and activity associated with your account.

Section 2 — Our Products

Vinstigator specializes in custom laser-engraved products, personalized gifts, keepsakes, and other handcrafted items.

We make reasonable efforts to accurately display and describe our products. However, colors and appearance may vary depending on your screen, lighting, photography, and the natural characteristics of the material.

Many Vinstigator products are individually made or personalized specifically for each customer. Minor variations are expected and are part of the handcrafted nature of our products.

Product descriptions, availability, designs, and specifications may be changed or discontinued when necessary.

Section 3 — Custom & Personalized Orders

Customers are responsible for carefully reviewing all personalization information submitted with an order, including:

Names
Rank or title
Dates
Branch of service
Unit or organization
Quotes and messages
Spelling
Photographs
Logos
Artwork
Design selections
Other customer-provided information

Vinstigator is not responsible for errors contained in information supplied or approved by the customer.

If Vinstigator makes a legitimate error while producing your order, we stand behind our work and will make it right in accordance with our Return & Refund Policy and Quality Guarantee.

Because personalized products are made specifically for the customer and generally cannot be resold, custom and personalized products are generally considered final sale except as provided by our Return & Refund Policy.

Section 4 — Custom Artwork, Photographs & Design Adjustments

Custom engraving may require adjustments to photographs, artwork, text, spacing, contrast, sizing, or layout to produce the best possible engraving.

By ordering a customized product, you authorize Vinstigator to make reasonable production adjustments, including:

Resizing or repositioning artwork
Adjusting brightness or contrast
Preparing photographs for laser engraving
Simplifying details that are too fine to reproduce properly
Adjusting text size or spacing
Repositioning elements to fit the product
Other minor changes reasonably necessary for successful production

If a substantial change to the requested design is necessary, we may contact you before production.

Section 5 — Customer-Provided Content

By submitting a photograph, logo, artwork, design, text, or other material, you represent that you own the material or have the appropriate rights or permission to use it for the requested product.

You authorize Vinstigator to reproduce and make reasonable production adjustments to the submitted material as necessary to design, produce, and fulfill your order.

Vinstigator reserves the right to decline a design or order that we reasonably believe we cannot legally, safely, appropriately, or successfully produce.

Section 6 — Natural Materials

Many Vinstigator products are made from natural materials, including bamboo, wood, and slate.

Natural variations may include differences in:

Grain
Color
Knots
Texture
Thickness
Edges
Mineral characteristics
Surface appearance

These natural characteristics are expected and are not considered defects.

Laser engraving can also vary slightly in darkness, contrast, and appearance because natural materials do not react identically to the engraving process.

Product photographs and previews represent the general appearance of a finished product but cannot guarantee identical grain, coloration, engraving shade, texture, or other naturally occurring characteristics.

Section 7 — Quality Guarantee

Vinstigator stands behind the quality of our materials and workmanship.

A significant structural or functional material failure under normal intended use, a manufacturing defect, shipping damage, or a legitimate production error by Vinstigator may qualify for a repair, remake, replacement, or refund under our Return & Refund Policy and Quality Guarantee.

Normal wear, accidental damage, misuse, improper care, and expected variations in natural materials are not considered manufacturing defects.

Customers are responsible for following the care instructions provided with the product or contained in the applicable product listing.

Section 8 — Orders

When you place an order, you are making an offer to purchase from Vinstigator. We reserve the right to accept, decline, limit, or cancel an order when reasonably necessary.

Payment must be successfully processed before an order is produced unless another arrangement has been expressly agreed upon.

Please review your order carefully before submitting it. Because customized products may enter design or production shortly after an order is received, we may be unable to accommodate cancellation or modification requests once work has begun.

If we cancel a paid order before production, the applicable payment for the canceled portion will be refunded.

Purchases are subject to our Return & Refund Policy.

Section 9 — Prices & Billing

Prices, discounts, and promotions may change without notice.

The price charged will be the price shown when the order is placed, including any customization or options selected by the customer.

Unless otherwise stated, displayed prices may not include applicable taxes, shipping, handling, customs duties, or import charges.

You agree to provide accurate and complete payment and billing information and represent that you are authorized to use the payment method provided.

Section 10 — Production, Shipping & Delivery

Because many Vinstigator products are made to order, production times may vary depending on customization, material availability, order volume, and other circumstances.

Production and delivery dates are estimates unless expressly guaranteed.

Customers are responsible for providing an accurate and complete shipping address.

We are not responsible for delays caused by shipping carriers, customs processing, severe weather, or other events reasonably outside our control.

If your order arrives damaged, please retain the product and its original packaging and contact us according to our Return & Refund Policy.

Section 11 — Returns, Replacements & Refunds

Because most Vinstigator products are custom-made or personalized, they generally cannot be returned or exchanged because of a change of mind or an error in information supplied by the customer.

However, we stand behind our materials and craftsmanship.

Eligible defects, significant material or workmanship failures, shipping damage, or legitimate errors made by Vinstigator will be handled according to our Return & Refund Policy and Quality Guarantee.

Please contact us before returning any product. Unauthorized returns may not be accepted.

Section 12 — Intellectual Property

Unless otherwise stated, Vinstigator retains ownership of its original designs, photographs, graphics, logos, branding, website content, product designs, and other original creative materials.

Purchasing a Vinstigator product does not transfer ownership of Vinstigator intellectual property or grant permission to reproduce or commercially distribute our original designs.

Customer-provided artwork remains the property of its respective owner.

The Services and their content may also include intellectual property belonging to Shopify or other third parties. Those materials remain the property of their respective owners.

Section 13 — Optional Tools & Third-Party Services

We may provide access to tools, features, links, or services operated by third parties.

Such third-party services may have their own terms, conditions, and privacy policies. Your use of those services is at your own discretion and may be subject to the third party's terms.

Vinstigator is not responsible for the content, security, accuracy, products, or services of third-party websites that we do not control.

Section 14 — Relationship with Shopify

Vinstigator is powered by Shopify, which enables us to provide the Services to you.

However, any sales and purchases you make through our store are made directly with Vinstigator.

By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Vinstigator, including injury, damage, or loss resulting from products or services purchased from Vinstigator.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims arising from or related to purchases and transactions made directly with Vinstigator.

Section 15 — Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our store is hosted by Shopify, Shopify also collects and processes certain information necessary to operate, secure, and improve the Services.

Section 16 — Reviews, Feedback & Submissions

If you voluntarily submit reviews, suggestions, feedback, or other content regarding Vinstigator or our products, you grant Vinstigator permission to use that content for reasonable business purposes, including operating, improving, and promoting our products and Services.

You represent that content you submit does not violate the rights of another person or entity.

We reserve the right to remove unlawful, abusive, misleading, infringing, or otherwise inappropriate content.

Section 17 — Errors, Inaccuracies & Omissions

Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions relating to product descriptions, dimensions, pricing, promotions, shipping charges, transit times, or availability.

We reserve the right to correct errors, update information, or cancel an affected order when reasonably necessary.

If a paid order is canceled because of an error on our part, the applicable payment will be refunded.

Section 18 — Prohibited Uses

You may use the Services only for lawful purposes.

You may not use the Services to:

Violate applicable laws or regulations
Infringe intellectual property or other legal rights
Engage in fraud or deceptive activity
Harass, threaten, abuse, or harm another person

We may restrict or terminate access to the Services when we reasonably determine that these Terms have been violated.

Provisions that by their nature should survive termination—including intellectual property, limitations of liability, indemnification, governing law, and privacy obligations—will continue to apply.

Section 20 — Disclaimer of Warranties

Except for the express commitments contained in our Quality Guarantee and to the fullest extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

We do not guarantee that the website will always be uninterrupted, error-free, or completely secure.

Nothing in these Terms is intended to exclude warranties, consumer protections, or other rights that cannot legally be excluded.

Section 21 — Limitation of Liability

To the fullest extent permitted by applicable law, Vinstigator will not be liable for indirect, incidental, special, punitive, or consequential damages resulting from use of the Services or products purchased through the Services.

Nothing in these Terms limits liability or consumer rights where such limitation is prohibited by law.

Section 22 — Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Vinstigator, Shopify, and their applicable affiliates, employees, contractors, and service providers from third-party claims resulting from:

Your violation of these Terms
Your violation of applicable law
Your infringement of another party's rights
Customer-provided content that you did not have the right or permission to use

Section 23 — Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary.

The remaining provisions will continue in effect.

Section 24 — Waiver & Entire Agreement

Failure to enforce a provision of these Terms does not constitute a waiver of that provision.

These Terms and the policies referenced herein constitute the agreement governing your use of the Services and supersede prior versions concerning the same subject matter.

Section 25 — Assignment

You may not assign your rights or obligations under these Terms without our prior written consent.

Vinstigator may assign its rights and obligations where permitted by applicable law.

Section 26 — Governing Law

These Terms and any separate agreements through which Vinstigator provides Services are governed by applicable federal law and the laws of the Commonwealth of Massachusetts, without limiting any consumer protections that cannot legally be waived.
